Overview

These Terms of Service (“Terms”) govern the use of services provided by Demur Design LLC (“we,” “our,” “us”). By booking a consultation, requesting services, or paying an invoice, you agree to these Terms.

SMS Opt-in Notifications

We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your Personal Data, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Email Marketing Notifications

We may use your email address to send you service updates and promotional communications, including appointment reminders, special offers, and news about our services. You can opt out at any time by clicking the Unsubscribe link in the footer of any marketing email or by contacting us directly. Information you provide via our contact form, during consultations, or through job payment transactions may be used to send these email notifications. We do not sell or share your email address with third parties for unrelated marketing purposes.

Consultations & Project Approval

Consultations are free and required before any project begins. After we meet, you’ll receive a custom proposal with pricing, timeline, and scope. If approved, we’ll move forward as outlined.

Invoicing & Payments

  • Invoices are due upon project completion unless otherwise stated.
  • A deposit of up to 20% may be required to cover upfront license or setup costs. This is non-refundable after 7 days.
  • If you cancel within 7 days and no setup costs have been incurred, you are eligible for a full refund.
  • If setup or licensing fees have already been rendered, that portion is non-refundable.
  • Projects going beyond the agreed scope may incur additional charges — you’ll be notified and must approve before work continues.


Membership & Subscription Services

Ongoing service plans (Social Media, Email Marketing, SEO, etc.) are billed monthly in advance.

  • Cancel anytime — billing ends with your current cycle.
  • Services do **not** roll over — unused content or hours expire each month.
  • It’s the client’s responsibility to attend or reschedule meetings. While we’ll follow up as needed, collaboration is required to keep projects on track. Missed meetings without notice may result in delays or forfeited deliverables.


Client Responsibilities

Clients agree to:

  • Provide timely access to files, feedback, and approvals
  • Communicate clearly and honestly throughout the project
  • Approve changes before final delivery
  • Failure to meet these responsibilities may result in delays or project cancellation without refund.


Intellectual Property

  • You retain full ownership of deliverables once your final invoice is paid.
  • We retain the right to display work in our portfolio unless otherwise requested.
  • Trademarking, licensing, and protecting your brand assets is your responsibility unless purchased as a service.


Payment Processing

  • Payments are handled through secure processors such as Stripe or Zoho.
  • Late or missed payments may delay service delivery or cancel the agreement.


Limitations of Liability

Demur Design LLC is not responsible for:

  • Issues caused by third-party platforms (e.g., Google, Meta, website hosts)
  • Algorithm or service changes that affect results
  • Downtime or delays caused by client inaction


Privacy & Communication

By working with us, you agree to our Privacy Policy. We use SMS and email alerts for reminders and updates. You can opt out at any time.

Changes to These Terms

We may update these terms as needed. Continued use of services means you accept the latest version.
