The Nevada AI Mental Health Law (AB 406) made Nevada one of the first states to explicitly wall AI off from professional mental health care. It has been in effect since June 5, 2025, taking effect immediately upon approval.
What the Nevada AI Mental Health Law Prohibits
The law prohibits AI providers from representing that their systems are capable of providing professional mental or behavioral health care, bars offering AI systems to the public as a substitute for a licensed provider, and restricts schools from using AI to perform counselor and psychologist functions. Licensed professionals may still use AI for administrative work such as scheduling and record management, but not for direct patient care or therapeutic communication.
Penalties and Compliance Steps
Violations carry civil penalties of up to 15,000 dollars per violation for AI companies, and licensed professionals who misuse AI face disciplinary action. Any company offering wellness or companion chatbots accessible in Nevada should audit its marketing claims and product behavior against this law, since both what a product says about itself and what it actually does with users can create liability.
