Illinois AI Video Interview Act (HB 2557)

The Illinois AI Video Interview Act (HB 2557, Public Act 101-0260) is one of the first AI hiring laws in the country, in effect since January 1, 2020. It governs employers that use AI to analyze video interviews of applicants for Illinois-based jobs.

Illinois AI Video Interview Act Requirements

Employers must tell applicants beforehand that AI may be used, explain how the AI works and what characteristics it evaluates, and get the applicant’s consent. Consent is not a formality here. Without those three steps, AI analysis of the interview is off the table.

Video Handling and Reporting

Interview videos can only be shared with people whose expertise is needed, and employers must delete a video within 30 days of an applicant’s request. A 2021 amendment added demographic reporting requirements for employers that rely solely on AI to decide who advances to in-person interviews.

For hiring teams, the compliance pattern is notice, explanation, consent, restricted sharing, and prompt deletion on request. Any AI interview vendor serving Illinois employers should have all five built into the product workflow by default.
