The New Hampshire Political Deepfake Law (HB 1596, codified at RSA 664:14-c) bans distributing deepfakes of candidates, election officials, or parties within 90 days of an election unless the media carries a clear disclosure that it was manipulated or generated by AI and depicts speech or conduct that did not occur. Lawmakers enacted it months after a widely reported AI robocall incident that preceded the 2024 New Hampshire primary, and it has been in effect since August 2024.
Disclosure Rules Under the New Hampshire Political Deepfake Law
Text disclosures must be as large as the biggest text in the ad. Audio disclosures must be spoken at the beginning, the end, and at least every two minutes.
Remedies and Exemptions
Targeted candidates and officials can seek injunctions and damages. Platforms, unknowing distributors, news coverage, and satire are exempt. Political advertisers using any generative AI in New Hampshire races should build the disclosure in by default.
