Oklahoma Telephone Solicitation Act Requirements

The law requires prior express written consent before making automated or prerecorded sales calls or texts to Oklahoma residents. It restricts commercial solicitation to 8 a.m. to 8 p.m., caps contact at three attempts per 24 hours on the same subject, requires accurate caller ID transmission, and prohibits technology that conceals the caller’s identity. Exemptions cover isolated transactions, certain nonprofits, and religious, charitable, political, and educational solicitations.

Private Right of Action and Class Exposure

Like Florida’s statute, the Act carries a private right of action with 500 dollars per violation, trebled up to 1,500 dollars for knowing or willful violations, which makes it attractive to class action plaintiffs.
