California AB 2355: AI Political Ad Disclosure Law (2024)

Effective Date: 2025-01-01

California AB 2355 requires political campaign committees that create or distribute ads containing AI-generated or substantially AI-altered images, audio, or video to include a disclosure. The required statement reads: “Ad generated or substantially altered using artificial intelligence.” The law has been in effect since January 1, 2025.

What California AB 2355 Requires by Medium

Formatting requirements vary by medium across TV, radio, print, and digital. A committee running the same AI-assisted creative in multiple channels needs to check the placement and format rules for each one, since a disclosure that satisfies the print standard will not automatically satisfy the broadcast standard.

Enforcement and Compliance

Enforcement runs through the Fair Political Practices Commission with injunctive and administrative remedies. Agencies producing political creative in California must build this disclosure into any AI-assisted campaign asset from the start of production. Treating the label as part of the creative template, rather than a last-minute addition, is the practical way to keep every version of an ad compliant across formats.
