California AI Transparency Act (SB 942)

The California AI Transparency Act (SB 942) requires large generative AI providers to help the public tell AI content from authentic content. It applies to covered providers, meaning generative AI systems with over one million monthly visitors or users that are publicly accessible in California.

What the California AI Transparency Act Requires

Providers must offer a free AI detection tool, embed latent (machine readable) disclosures identifying content as AI generated, and offer users the option of a visible manifest disclosure. Providers must also revoke licenses of third parties that strip these disclosures.

Penalties and Compliance Deadline

Penalties run $5,000 per violation per day, enforced by the Attorney General and local prosecutors. Compliance was originally due January 1, 2026, but AB 853 moved the deadline to August 2, 2026 and layered platform and device obligations on top in 2027 and 2028.
