Maine AI Therapy Law: AI in Mental Health Services (LD 2082)

The Maine AI Therapy Law (LD 2082) prohibits anyone from providing, advertising, or offering therapy or psychotherapy services to the public, including through internet-based AI, unless the services are delivered by a licensed professional. Signed April 13, 2026 as Public Law chapter 687, it takes effect July 29, 2026.

What the Maine AI Therapy Law Prohibits

AI cannot make independent therapeutic decisions, conduct therapeutic communication with clients, or generate treatment plans or recommendations without clinician review. Companies offering AI “therapy” chatbots cannot market them as therapy to Maine consumers, which puts direct-to-consumer mental health apps on notice about how they describe their products in the state.

How Licensed Professionals Can Use AI

Licensed professionals may use AI only in administrative and supplementary roles under their full responsibility. Supplementary use in recorded or transcribed sessions carries an extra step: the clinician must inform the client in writing and obtain written, revocable consent before AI touches the session.
