Michigan AI Political Ad Law: Disclosure Requirements (HB 5141)

The Michigan AI Political Ad Law (HB 5141, Public Act 263 of 2023) requires that any qualified political advertisement generated in whole or substantially by artificial intelligence carry a clear and conspicuous disclosure stating that it was AI-generated. It has been in effect since February 13, 2024, and Michigan was the fifth state to require AI disclosure in political advertising.

Michigan AI Political Ad Law Disclosure Formats

The format rules are specific. For audio ads, the statement must be clearly audible for at least three seconds at the beginning or end. For video, the disclosure must be both spoken for at least three seconds and displayed on screen in readable text for at least four seconds. Meeting one channel’s rule does not satisfy the other.

Who Must Comply

The law applies to anyone who creates, publishes, or pays for covered political ads in Michigan. It works alongside companion legislation, HB 5143 (Public Act 264 of 2023), which added AI definitions to state campaign law. Production teams should build the timed audio and on-screen disclosures into their edit process rather than adding them after the fact.
