The North Dakota AI Political Ad Law (HB 1167) adds a new section to the state’s corrupt practices election chapter requiring a disclaimer, in capital letters, on any political communication or advertisement created wholly or partly with artificial intelligence tools. Signed April 11, 2025 after unanimous votes in both chambers, it has been in effect since August 1, 2025.
What the North Dakota AI Political Ad Law Requires
The required wording states that the content was generated by artificial intelligence, and it must appear in capital letters. The trigger is broad: content created wholly or partly with AI tools falls under the rule, whether the AI contribution is an image, audio, video, or text.
Who Must Comply
The law covers ads and communications involving candidates, political committees, political parties, and ballot measure committees or petitions. That sweep captures essentially every organized actor in a North Dakota race.
Campaigns and agencies producing political creative for North Dakota need to label anything touched by generative AI. Given the partly-created trigger, the safest workflow is to apply the disclaimer whenever AI appears anywhere in production.
